Winnipeg Impact Fees – Legal Challenge Update

Today, the court order finalizing the decision in the Impact Fee court application was signed by Justice Edmonds and took immediate effect. The court order quashes the City of Winnipeg’s Impact Fee by-law and instructs the City to refund the fees collected plus interest to those who paid them. With the court order now in effect, the 30-day window for the parties to appeal the decision has begun.

While the City of Winnipeg has publicly indicated they do not intend to appeal the decision, they continue to have the opportunity to appeal until the appeal window has concluded. At any time during this window, the City can change their position and decide to appeal the court decision. Should they decide to appeal, the by-law will likely remain in place until the appeal process has concluded.
